CA students of the Institute of Chartered Accountants of India (ICAI) staged a protest outside its branch offices in all over India i.e. Delhi, Mumbai, Kolkata, Chennai, Kanpur, Lucknow, Raipur, Jhansi, Jaipur, Varansi, Nagpur, etc. the students claiming that:
- 100% MCQs type questions paper for every level of Chartered Accountants Examination.
- Rule 39(4) of ICAI, Act 1949 should be ammend and allows the right of Rechecking of Copies and these copies provide to Students alongwith suggested answers.
- ICAI create a Grievance Window where every problem could be register by students and resolve with in 24 hours.
What is section 39(4)?
For the answer we visited ICAI website and found that:
(a) A list of candidates declared successful at each examination shall be published
(b) The names of candidates obtaining distinction in the examination shall be indicated in the list
(c) Every candidate shall be individually informed of his result.
The Council may, in its discretion, revise the marks obtained by all candidates or a section of candidates in any particular paper or papers or in the aggregate in such manner as may be considered necessary, for maintaining the standards of pass percentage provided in these Regulations.
Explanation – The term “section” used in this sub regulation refers to the category of the candidates whose answer papers are value by an examiner and such other category of candidates as may be specified by the Council.
A candidate who passes at one siting an examination with seventy per cent of the total makrs for all the papers for that examination shall be considered to have passed the examination with distinction.
Explanation – For the purpose of reckoning the seventy percent marks mentioned in this sub-regulation, any fractions of half or more shall be rounded upto the next whole number.
(i) Information as to whether a candidate’s answers in any particular paper or papers of any examination have been examined and marked shall be supplied to the candidate on his submitting within a month of the declaration of the result of the said examination, an application, accompanied by a fee of twenty rupees per paper subject to maximum of fifty rupees.
(ii) The fee shall be only for verifying whether the candidates answers in any particulars paper or papers have been examined and marked, and not for the reexamination of the answers
(iii) The marks obtained by a candidate in individual questions or in sections of a paper shall not be supplied.
(iv) If as a result of such verification, it is discovered that there has been either an omission to examine or mark any answer or answers or there has been mistake in the totalling of the marks, the fee for verification shall be refunded in full to the candidate.
Every candidate shall be furnished free with a statement of makrs obtained by him in the papers in which he has appeared in the examination
Provided that if a request for the statement of marks secured by a candidate at any examination is received after the expiry of two months from the date of declaration of the result of the examination, the statement shall be furnished on payment of a fee of two rupees for each paper subject to a maximum of ten rupees.
Notwithstanding that a candidate has obtained the minimum number of marks for passing an examination, the Examination Committee may after giving an opportunity to the candidate of being heard, for reasons to be recorded in writing, refuse to declare him to have passed the examination.
In any case where it is found that the result of any examination has been affected by error malpractice, fraud, improper conduct or other matter, of whatever nature, the Council shall have the power to amend such result, In such manner as shall be in accordance with the true position and to make such declaration as the Council shall consider necessary in that behalf:
Provided that no such amendment shall be made which adversely affects a candidate, without giving him an opportunity of being heard:
Provided further that in the event of any error no arising out of any act or default of a candidate, proceedings for amendment adversely affecting the candidate shall not be initiated after the expiry of a period of one month from the date of the declaration of result.
All students are asking for ammend this section until they protest it. However, No official statement has been given so for by ICAI in this regard.
